1. Acceptance of Terms
By accessing or using poetpearl.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree to all terms, please do not use the Site. We reserve the right to update these terms at any time without prior notice. Your continued use of the Site after any changes constitutes acceptance of the revised terms.
2. Products & Descriptions
We make every effort to display our products accurately, including colors, sizes, and descriptions. However, due to the natural variation of baroque pearls, no two pieces are identical. The product you receive will be similar in character to the images shown but may vary in shape, surface texture, or minor color tone.
All prices are listed in USD and are subject to change without notice. We reserve the right to modify or discontinue any product at any time.
3. Orders & Payment
By placing an order, you are making an offer to purchase products subject to these Terms. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or description, or suspected fraudulent activity.
Payment is due at the time of order. We accept Visa, Mastercard, American Express, PayPal, Apple Pay, and Google Pay. All transactions are processed securely through Stripe and PayPal. We do not store your full credit card information.
4. Shipping & Delivery
Shipping timeframes are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control. Risk of loss and title for items passes to you upon delivery to the carrier.
International customers are responsible for all customs duties, taxes, and import fees. Please refer to our Shipping Policy for full details.
5. Returns & Refunds
We offer a 30-day return policy for unworn items in their original packaging. To initiate a return, please email [email protected]. Refunds are processed to the original payment method within 5-10 business days of receiving the returned item. Custom orders and engraved pieces are final sale. 6. Intellectual Property
All content on this Site — including text, images, logos, designs, product names, and the "PoetPearl" brand — is the intellectual property of PoetPearl and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
7. User Conduct
You agree not to use the Site for any unlawful purpose or in violation of these Terms. You may not interfere with the security of the Site, attempt to gain unauthorized access, transmit malware, or engage in any activity that disrupts or damages the Site or its users.
8. Limitation of Liability
PoetPearl shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product(s) in question.
9. Indemnification
You agree to indemnify and hold harmless PoetPearl from any claims, damages, or expenses arising from your breach of these Terms or your use of the Site.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of New York.

12. Partner & Wholesale Program
Partners may join at the Explorer, Maker, Merchant or Partner tier. Wholesale and dropship orders are final sale and eligible for exchange or store credit only — no cash refunds. Tier status is reviewed quarterly based on purchase volume. First-order offer POETNEW1 applies to retail orders only and cannot be combined with Partner Program discounts. 13. Minimum Advertised Price (MAP) Policy
Partners agree not to advertise PoetPearl products below the published MSRP. In-cart discounts, free shipping and bundles are permitted provided the advertised price is at or above MSRP. See the full policy at /map.
