Minimum Advertised Price (MAP) Policy

1. Purpose
PoetPearl (the "Brand") has adopted this Minimum Advertised Price (MAP) Policy to protect the value of the PoetPearl brand, preserve the integrity of our pricing, and promote fair competition among our authorized resellers and partners. This Policy is a unilateral statement of policy adopted by the Brand.
2. Definition of MAP
The Minimum Advertised Price (the "MAP") for each product is the Manufacturer's Suggested Retail Price (MSRP) published by the Brand. "Advertised Price" means the price displayed to consumers in any advertisement or public listing.
3. Scope
This Policy applies to all advertising and public display of PoetPearl products, including but not limited to: websites and e-commerce stores, third-party marketplaces, social media, email and newsletters, printed materials, and any other media visible to consumers.
4. Permitted Practices
Resellers may:
- Advertise PoetPearl products at or above MAP;
- Offer discounts inside the shopping cart or at checkout, provided the advertised price remains at or above MAP;
- Offer free or discounted shipping;
- Operate loyalty, membership, or reward programs;
- Offer product bundles, provided the advertised price of each item remains at or above MAP.
5. Prohibited Practices
Resellers may not:
- Advertise any PoetPearl product below MAP;
- Display any price, coupon or promotion that results in an advertised price below MAP;
- Communicate any below-MAP price in any manner visible to consumers.
6. Monitoring and Enforcement
The Brand monitors advertised prices for compliance. If a reseller advertises below MAP, the Brand may, in its sole discretion: (a) issue a written notice requesting correction; (b) suspend access to wholesale pricing and materials; (c) suspend or terminate the reseller relationship. These actions are unilateral and are not a penalty for any agreement regarding resale price.
7. Nature of This Policy
This Policy is a unilateral policy of the Brand. It is not an agreement, contract, or condition of sale, and it does not establish or restrict the price at which any reseller may resell PoetPearl products.
8. Modification and Termination
The Brand may modify or terminate this Policy at any time without notice.
